4.562 Compliance
Pursuant to California Rules of Court, Rule 4.562, "Each Court of Appeal must establish a death penalty-related habeas corpus panel committee as provided in this rule. [. . .] Committees will provide to the Habeas Corpus Resource Center the names of attorneys who the committees determine meet the minimum qualifications. The Habeas Corpus Resource Center must consolidate the names into a single statewide panel, update the names on the panel at least quarterly, and make the most current panel available to superior courts on its website."
HCRC endeavors to update this list within one week of any of the following events:
- Receipt of the name of one or more attorneys for inclusion on the statewide panel from one of the committees. (See rule 4.562(d)(4)(A)-(B).)
- Receipt of notice that a panel member has resigned from the Regional Committees.
- HCRC’s internal tracking reflecting that six years have elapsed since an attorney was approved for the statewide panel, together with confirmation that the member has not renewed their application. (See rule 4.562(d)(4)(C).)
- Receipt of information indicating that a panel member should be removed pursuant to rule 4.562(d)(6).
